A Settlement has been proposed in the class action lawsuit referenced above pending in the Circuit Court for the 20th Judicial Circuit, County of St. Clair, State of Illinois (the “State Action”) that relates to claims in the Class Action Complaint as well as the Federal Action, which was a class action complaint filed on Tuesday, March 17, 2020, in the United States District Court for the Northern District of Illinois, titled Dominique Freeman v. MAM USA Corporation, Case No. 1:20-cv-01834. (the State Action and Federal Action together are the “Actions”). If the Court gives final approval to the Settlement, MAM USA Corporation (“MAM USA”) will provide, for each Settlement Class Member who purchased, for personal use and not for resale, any Covered Product from Thursday, March 17, 2016 through Monday, September 30, 2024, and properly and timely completes and submits an Approved Claim, at the Settlement Class Member’s choice, a Cash Award OR one electronic Product Voucher, which may be applied toward any purchase at mambaby.com/en-us per the terms of the Settlement Agreement.

If you purchased one or more of the Covered Products from Thursday, March 17, 2016 through Monday, September 30, 2024, and submit a Valid Claim Form, you can receive a Cash Award of up to $1.50 without proof of purchase or a Cash Award of up to $20 with Valid Proof of Purchase or one Product Voucher up to $6 without Valid Proof of Purchase or one product voucher up to $30 with Valid Proof of Purchase. EXCLUDE YOURSELF

If you exclude yourself from the Settlement, you will not receive a Benefit under the Settlement. Excluding yourself is the only option that allows you to bring or maintain your own lawsuit against MAM USA for the allegations in the Actions ever again.

GO TO THE "FAIRNESS HEARING"

The Court will hold a “Fairness Hearing” to consider the Settlement, the request for Attorneys’ Fees and Costs of the lawyers who brought the Actions, and the Named Plaintiff’s and the New York Plaintiff’s request for Service Awards for bringing the Actions. 

You may, but are not required to, speak at the Fairness Hearing about any objection you filed to the Settlement. If you intend to speak at the Fairness Hearing, you must also submit a “Notice of Intention to Appear” indicating your intent to do so.

DO NOTHING

If you purchased one or more Covered Products during the Class Period: if you do nothing, and the Court approves the Settlement, you will not receive any Benefit. You will also give up your right to object to the Settlement and you will not be able to be part of any other lawsuit about the legal claims in this Actions.

  • The Court in charge of the Class Action Complaint has preliminarily approved the Settlement and must decide whether to give final approval to the Settlement. The relief provided to Settlement Class Members will be provided only if the Court gives final approval to the Settlement and, if there are any appeals, after the appeals are resolved in favor of the Settlement. Please be patient.
